Professional Background
A specialist in Psychiatry in Ontario since 1976, currently in Private Practice. Founder (in 1988) and Co-ordinator (until March 30, 2002) of the Competency Clinic at The Baycrest Centre for Geriatric Care. Adjunct Professor of Psychiatry and founding Member of the Joint Centre for Bioethics at University of Toronto. Successfully completed training from the Capacity Assessors Office of the Public Guardian and Trustee of Ontario and remained on the roster from the outset until December 1, 2007. Continues to be a capacity assessor for Court Ordered Guardianship of the Person under the Substitute Decisions Act, 1992 (the “SDA”) and other such assessments.
Published two books co-authored by lawyers, and eleven book chapters on mental capacity to perform legal tasks. Published 60+ scientific articles on capacity, several of which have appeared in law journals; contribution to the Inquiry on Mental Competency is acknowledged in that report. Consulted to the Inquiry on Non-Therapeutic Medical Procedures on Behalf of Mentally Incompetent Individuals and the Royal Commission on Electoral Reform and frequently contributes to continuing legal education in this field. Regularly teaches courses for The Canadian Bar Association, The Law Society of Upper Canada CLE, and The Canadian Institute; has contributed to courses in undergraduate legal education both at the University of Toronto Faculty of Law and at the Osgoode Faculty of Law at York University.
